Outdoor Christmas light company Frisco

Christmas Lighting will provide design, installation, removal and storage of holiday lighting and decorations. All lighting and decorations remain the property of Christmas Lighting and are leased to the client. The following terms of service outlines the expectations and acknowledgment of the client.

Lighting and Decorations

  • Christmas Lighting guarantees the quality of our lighting, decorations and workmanship as described below. Should any problems arise, please let our office know so we can correct them as soon as possible.

  • All exterior cleaning, tree maintenance or tree, hedge and bush trimming should be completed prior to lighting installation. Once the lights are installed, any exterior cleaning or trimmings will risk damaging the lights.

  • Homeowners are responsible for providing and maintaining functional electrical outlets suitable for lit decorations, tree lights, and building lights. GFCI receptacles are crucial, interrupting power to prevent shocks in the presence of water, rain, dew or sprinklers. Wet areas may take time to completely dry before power can be restored. Lighting or decoration outages must be reported. Christmas Lighting is not responsible for unreported outages or outlets that won’t reset because of moisture.

  • Repairs needed to lighting or decorations due to vandalism, extraordinary weather conditions, damaged or cut lines due to animals, pests, landscapers, or other service providers, and customer added lights are not warrantied and will be billed as additional services.

  • Christmas Lighting is not responsible for power outages or tripping of GFCI circuits caused by inclement weather. Though we’ll perform the necessary service calls to address these issues, we won’t be held liable for any damages resulting from natural causes.

  • If the client attempts to change timer settings and a resolution cannot be made over the phone to fix settings, a $75 service fee will be charged to the client.

  • Using lighting sets not provided by Christmas Lighting in timers or plugs provided by Christmas Lighting will void the warranty and result in a minimum fee of $75, in addition to an hourly rate to address any arising issues.

  • Christmas Lighting will commence the installation process for all of our current clients throughout October and the first week of November. During this period, our expert team will be adding roof lighting as well as tree and shrub installation. These enhancements allow Christmas Lighting to not only keep pace with demand from new clients, but also maintain a high level of customer satisfaction.

  • Our seasonal business is weather-dependent. We prioritize the safety of our staff, your home, and the materials used, ensuring everyone’s satisfaction in showcasing the festive holiday of lighting and decoration. Our team will work diligently to fulfill your needs in a safe and timely manner.

  • Christmas Lighting retains sole discretion as to the timing of services and no breach of contract occurs based on dates of service.

  • Temporary Lighting: The standard lighting installed is exclusively intended as seasonal, temporary lighting activated by timers unless specified otherwise. For 90 days, Christmas Lighting provides warranty only for seasonal lighting, after which the warranty will be voided if the homeowner chooses to run lighting continuously without a timer, post the first season.

  • Permanent Lighting: Should permanent lighting be requested, a monthly service fee will be incurred. In the event of unsolvable problems requiring a lift instead of ladders, we will charge the client a rental fee. Additional fees will apply for any necessary material replacements throughout the year.

  • For a three-year period from the original installation date, we will replace any non-functioning bulbs or miniature light sets at no extra charge upon reinstallation.

  • As trees, bushes and foliage grow, we can add additional lights to any landscaping. We will communicate with the client to add on additional lighting and will invoice accordingly.

  • Bows on wreaths: Although there isn’t a warranty on bows, Christmas Lighting will replace a dislodged bow at no additional cost, providing a new one for the season.

  • Photographs and Video: Unless agreed otherwise, Christmas Lighting reserves the right to take photographs and/or video of the lighting and decoration services provided on the client’s property. These may be utilized for marketing purposes, including but not limited to brochures, portfolios, internet or postcards. The use of photographs and/or video does not incorporate any financial compensation. Addresses are not disclosed, excluding the town name. In addition, we reserve the right with commercial accounts to state the property name and/or address.

  • Our service covers everything, from materials and set up to installation, labeling, removal, and boxing of lighting and decorations. Furthermore, we provide storage for all these materials as part of our service. All lighting decor is leased by Christmas Lighting to the client and will be removed and stored by Christmas Lighting.

Maintenance

  • All installations come with unlimited maintenance visits where our equipment and supplies are at fault. This includes but is not limited to replacing bulbs that have gone out, timers that are set up improperly, fixing fasteners or clips that are not properly holding lights. If a maintenance visit reveals that the issue is to no fault of the installers and Christmas Lighting, after the second similar visit the client will be invoiced to the client for any parts and labor. All maintenance due to landscaping errors will be invoiced to the client for parts and labor. All maintenance visits will be documented and shared with the client.

  • To schedule maintenance, clients will be required to call our office, or email us to inform us of the outage. Christmas Lighting will be following up within 24 hours to schedule a 24 hour window that our team will be available to resolve the maintenance request. This channel of communication takes ultimate precedence over all forms of communication and is monitored by the owners and every team member. Rest assured, there is no need to follow up beyond filling out emailing, or calling.

  • In the event that a GFCI trips and the client is unable to reset, Christmas Lighting will come out to determine the cause up to two times. After two visits, it is necessary for the client to hire an electrician to install a new breaker.

  • All service requests for light maintenance will conclude on December 31st.

Billing and Payments

  • Billing Issues: In the event that you have questions regarding any billing, please contact our office within 7 days, or we will assume that billing is correct. All services, unless otherwise agreed upon, are billed at time of installation.

  • Our billing system is designed for ease and flexibility. When scheduling installation, 50% of the total cost is due as a deposit. The remaining 50% is due on the installation date. To simplify the billing process, returning clients can enroll in our recurring Early Bird payment program. This program allows you to pay in advance for services between March and August.

  • If payment is not received within the invoice terms, we will assess and expect a finance charge of 18% per annum on the unpaid balance from the due date until full payment is received by Christmas Lighting. The finance charge will not exceed the maximum amount allowed by law.

  • Payment is required upon installation of lights. If payment is not received during installation, the credit card on file will be charged the following day.

  • Please ensure payment is received within 14 days of the invoice date to avoid a 10% late fee. If payment is not received within 21 days, an additional 15% fee will be added to the bill. After 30 days of the invoice date, a 20% fee will be charged. Please note that these fees may vary depending on contractual agreements with the client.

  • Payments received will be applied first to any outstanding finance charges, with the remaining amount applied to the unpaid balance on the account. If the client fails to make payments as required, the account will be considered in default and the client will be responsible for costs of collection and attorney fees, as allowed by law and in a reasonable manner.

Limited Warranty and Limitation of Liability and Remedies: BOTH PARTIES TO THIS CONTRACT AGREE THAT IN THE EVENT OF THE FAILURE OR MALFUNCTION OF THE LIGHTING AND/OR DECORATIONS PROVIDED, THE SOLE AND EXCLUSIVE REMEDY AVAILABLE TO THE CLIENT SHALL BE THE REFUND OF THE COST OF THE SERVICES PROVIDED UNDER THIS AGREEMENT OR THE REPAIR OR REPLACEMENT OF THE LIGHTING AND/OR DECORATIONS, TO BE DETERMINED SOLELY AT THE DISCRETION OF THE SERVICE PROVIDER. BOTH PARTIES AGREE THAT Christmas Lighting WILL NOT BE LIABLE FOR ANY CONSEQUENTIAL DAMAGES OF ANY NATURE CAUSED TO THE PROPERTY OF THE CLIENT BY ANY FAILURE OR MALFUNCTION OF THE LIGHTING AND DECORATIONS PROVIDED UNDER THIS AGREEMENT. SOME STATES MAY NOT ALLOW FOR THE EXCLUSION OR LIMITATION OF INCIDENTAL AND CONSEQUENTIAL DAMAGES SO ABOVE LIMITATIONS AND EXCLUSION MAY NOT APPLY TO YOU. BOTH PARTIES AGREE THAT ANY CLAIM BY THE CLIENT THAT THE WORKMANSHIP OR MATERIALS

 

USED ARE DEFECTIVE OR NONCONFORMING MUST BE BROUGHT TO THE ATTENTION OF Christmas Lighting IN WRITING WITHIN 72 HOURS OF THE SERVICE AND FAILURE TO DO SO RESULTS IN A COMPLETE AND FINAL WAIVER OF ALL CLAIMS.

I have read, understand and agree to the above policies, terms, and conditions. Client has the right to rescind this contract by giving written notice to the service provider within three days from the date signed.
